Test Ride Terms & Liability Waiver

IMPORTANT – PLEASE READ CAREFULLY BEFORE PARTICIPATING

By booking and/or participating in a test ride with Roman Bicycles Ltd (“Roman Bicycles”, “we”, “us”, “our”), you acknowledge and agree to the following Terms and Liability Waiver.

1. Assumption of Risk

I acknowledge that riding a bicycle is an inherently hazardous activity and involves risks including, but not limited to:

  • Loss of control

  • Collisions with vehicles, pedestrians, or obstacles

  • Road and trail hazards

  • Mechanical failure

  • Weather conditions

  • Personal injury, serious injury, or death

I voluntarily choose to participate in a test ride and assume full responsibility for all risks, whether known or unknown, foreseeable or unforeseeable, arising from my participation.

2. Fitness to Ride

I confirm that:

  • I am physically and mentally fit to ride a bicycle.

  • I have no medical conditions that would make participation unsafe.

  • I am competent and confident to ride the selected bicycle.

  • I will immediately stop riding if I feel unsafe or unwell.

Roman Bicycles makes no assessment of my riding ability and relies solely on my declaration.

3. Bicycle Use & Care

I agree to:

  • Use the bicycle responsibly and for test ride purposes only.

  • Follow all instructions provided by Roman Bicycles staff.

  • Obey all UK road traffic laws, Highway Code rules, and local regulations.

  • Return the bicycle in the same condition as received (reasonable wear excepted).

I accept responsibility for loss, theft, or damage caused by misuse, negligence, or failure to follow instructions.

4. Helmet & Safety Equipment

I acknowledge that:

  • Wearing a helmet is strongly recommended.

  • I am responsible for ensuring proper fit and use of any safety equipment.

  • Roman Bicycles is not responsible for injuries arising from failure to wear protective equipment.

5. Liability Waiver & Release

To the fullest extent permitted by UK law, I agree to:

  • Release, waive, and discharge Roman Bicycles, its directors, employees, contractors, agents, and affiliates from any and all claims, demands, actions, or liabilities arising from my participation in the test ride.

This includes claims relating to:

  • Personal injury

  • Property damage

  • Financial loss

  • Accidents or incidents occurring during the test ride

Nothing in this waiver excludes or limits liability for death or personal injury caused by negligence, as prohibited under the Unfair Contract Terms Act 1977.

6. Indemnity

I agree to indemnify and hold harmless Roman Bicycles against any claims, losses, damages, costs, or expenses (including legal fees) arising from:

  • My actions or omissions during the test ride

  • Breach of these terms

  • Injury or damage caused to third parties

7. Insurance

I acknowledge that:

  • Roman Bicycles may carry insurance, but this does not replace my personal responsibility.

  • I am responsible for my own personal accident, health, and liability insurance.

8. Data Protection (GDPR)

Roman Bicycles will process my personal data in accordance with the UK GDPR and Data Protection Act 2018.

  • My data will be used solely for booking, communication, and safety purposes.

  • My data will not be shared with third parties without lawful basis.

  • I may request access to or deletion of my data at any time.

9. Governing Law

These terms shall be governed by and construed in accordance with the laws of England and Wales, and any disputes shall be subject to the exclusive jurisdiction of the English courts.

10. Declaration & Consent

By submitting the test ride booking form and/or participating in a test ride, I confirm that:

  • I have read and understood this agreement.

  • I voluntarily accept all risks.

  • I agree to be bound by these Terms and Liability Waiver.
